Warranty conditions

In addition to the statutory warranty and any manufacturers’ warranties, we also offer our customers a limited warranty on purchased hardware. Please see below for more detailed information regarding the subject matter and scope of the warranty, warranty periods and claims under the warranty.

1. WARRANTY

If the customer is…

  • a reseller: warranty for both new and used hardware is 90 days
  • an end customer: warranty for new hardware is 1 year, for used hardware 10 years

1.1 Resellers are customers who acquire goods for the purpose of selling them on to a third party.

1.2 End-customers are customers – whether an enterprise or consumer – who acquire goods for their own use.

1.3  New hardware is used to describe unused and unopened products in a flawless condition. These are delivered in their original packaging and original scope of supply.

1.4 Used hardware (refurbished hardware) has already been used and refurbished by us. The products are cleaned and tested, and are shipped in flawless technical condition. As a rule, they are not delivered in their original packaging.

2. CONTENT OF THE WARRANTY

2.1 We guarantee our customers that our hardware has no material, manufacturing or processing defects. This is determined according to the state-of-the-art at the time the equipment was manufactured.

2.2 Our warranties do not extend to software, batteries, licences, manufacturer’s maintenance contracts or comparable contracts.

2.3 Please note: We provide the services of our limited warranty in addition to our statutory liability for material defects. The right to claim under the warranty does not extend to consequential losses (losses incurred as a result of defective equipment) or losses incurred by third parties. However, your statutory rights, particularly those based on the laws relating to warranties, withdrawal and product liability, remain unaffected.

3. WARRANTY PERIOD

The length of the warranty (10 years, 1 year, 90 days) is calculated from the invoice date. The warranty period is not extended as a result of the provision of services under this warranty, and in particular not as a result of repair or exchange, nor does the warranty period start again from the beginning in such cases.

4. WRITTEN NOTIFICATION OF DEFECTS

The customer can assert the rights arising from this warranty by means of a written notification of defects within the warranty period. The customer must give notification of the defect immediately after recognising it or after he should have recognised it. It is up to the customer to prove that the warranty has not expired (for example by submitting the sales receipt).

5. PERFORMANCE IN RESPONSE TO WARRANTY CLAIMS

5.1 At our own discretion, we will either repair the defective goods or replace them with the same or a comparable product. Whichever course of action we choose, we will bear the costs.

5.2 We will bear the cost of returns (standard delivery by UPS or DHL). Please contact us regarding this issue before returning the goods. We will then send you a return material authorization (RMA form), which should be filled in as completely as possible. Please pack the goods carefully to protect them from transport damage.

6. PREREQUISITES, EXCLUSIONS AND EXPIRY

6.1 This warranty only applies if the products are professionally installed and maintained, and used in the correct manner.

6.2 Our warranty does not apply to defects that

  • result from incorrect installation, use or maintenance
  • result from use in an unsuitable environment or from damage caused by external influences such as water or incorrect voltage
  • result from physical damage or comparable actions
  • are only slight and have no influence on the usefulness of the hardware

6.3 Our warranty only applies to the party with whom we enter into a contract. It expires as soon as the goods are sold to a third party.

7. PLACE OF PERFORMANCE, JURISDICTION AND APPLICABLE LAW

The place of performance for obligations arising from the warranty is Rödermark. To the extent permissible, the parties submit to the jurisdiction of the Landgericht (district court) Munich I. German law applies to this warranty to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
